Monday, September 25, 2023 – In accordance with the relevant EU regulations, only the tailpipe emissions of a vehicle have so far been used to determine the CO2 emission levels of new vehicle fleets of manufacturers of passenger cars and light commercial vehicles.
A group of plaintiffs – Dr. Lorenz Kiene, the eFuel GmbH, eFuel Projektentwicklung GmbH and CLASSIC Service Stations GmbH & Co. KG. – from the mid-sized energy trading company has in July 2023 against exactly this tightening of CO2 emission standards filed a lawsuit before the European Court of Justice, as this regulation slows down the development, production and sale of CO2-neutral synthetic fuels for motor vehicles to the detriment of climate protection.
The plaintiffs also feel that their fundamental rights, such as that of entrepreneurial freedom , have beenviolated. The defendant in the proceedings is the European Union, represented by the European Parliament and the Council of the European Union. The plaintiffs are represented by the law firm Osborne Clarke. The industry association UNITI e.V. supports the lawsuit.
