{"id":10051,"date":"2024-07-25T07:34:22","date_gmt":"2024-07-25T07:34:22","guid":{"rendered":"https:\/\/www.efuels-forum.de\/2024\/07\/25\/legal-opinion-against-the-eus-ban-on-combustion-engines\/"},"modified":"2024-07-25T07:34:22","modified_gmt":"2024-07-25T07:34:22","slug":"legal-opinion-against-the-eus-ban-on-combustion-engines","status":"publish","type":"post","link":"https:\/\/www.efuels-forum.de\/en\/2024\/07\/25\/legal-opinion-against-the-eus-ban-on-combustion-engines\/","title":{"rendered":"Legal opinion against the EU&#8217;s ban on combustion engines"},"content":{"rendered":"<div class=\"xdj266r x11i5rnm xat24cr x1mh8g0r x1vvkbs x126k92a\">\n<div dir=\"auto\"><strong>Is the ban on combustion engines not only wrong, but even illegal?<\/strong> According to many sources &#8211; including the Bild newspaper &#8211; a new <a href=\"https:\/\/www.uniti.de\/fileadmin\/user_upload\/UNITI_PM__Gutachten_EU_Flottenregulierung_20240722.pdf\" target=\"_blank\" rel=\"noopener\">legal opinion<\/a> on the so-called CO\u2082 fleet regulation by Professor Martin Kment (Institute for Environmental Law, University of Augsburg) clearly says: YES!<br \/>\nThe error lies in the EU&#8217;s current and underlying methodology for measuring CO\u2082 values, which has so far only been carried out at the exhaust pipe of a vehicle.<br \/>\nBut since electric cars have no exhaust, the CO\u2082 rating for e-cars is of course always 0 &#8211; and not for combustion cars!<br \/>\nAnd according to Kment, this is precisely what is not permitted.<br \/>\nIn his opinion, the EU&#8217;s CO\u2082 assessment should consider the entire CO\u2082 footprint.<br \/>\nIn the case of electric cars, the costly production process and the &#8220;dirty&#8221; charging current, which is partly generated by gas and coal, would also play a role.<br \/>\nBoth types of drive would then not be at 0 in the CO\u2082 assessment. In other words: either allow both or ban both!<br \/>\nIt&#8217;s about reducing CO\u2082 and not simply giving ideological preference to one type of drive, right?<br \/>\nEither way, it&#8217;s good that combustion engines can then also be refueled easily and quickly with modern, alternative fuels such as eFuels and <a href=\"https:\/\/klima-kraftstoffe.de\/\" target=\"_blank\" rel=\"noopener\">HVO<\/a> with a significant reduction in CO\u2082!        <\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Is the ban on combustion engines not only wrong, but even illegal?
